Client Service Agreement

This Client Service Agreement ("Agreement") governs all coaching engagements, certification programs, courses, and memberships (collectively, the "Services") provided by Embodied Vision LLC ("Provider", "we", "us") to you ("Client"). By enrolling, paying for, or participating in any of the Services, you confirm that you have read, understood, and agree to be bound by this Agreement.

1. Scope of Services

The specific Services you receive are described on the enrollment or sales page at the time of purchase. Services may include one-on-one coaching, group programs, certification trainings, online courses, memberships, recorded materials, and live sessions.

Services are educational and developmental in nature. They are not a substitute for medical, psychological, psychiatric, legal, or financial advice or treatment.

2. Fees and Payment

• Fees are stated at the point of purchase and are payable in the currency specified.
• Where payment plans are offered, you authorize us and our payment processor, Kajabi Payments (powered by Stripe), to charge each instalment on its scheduled date.
• If a payment fails, we may suspend access until the balance is brought current. Repeated failure may result in termination of access without refund of amounts already paid.
• You are responsible for any applicable taxes, bank fees, or currency conversion costs.

3. Refunds and Cancellations

Because of the digital and personalised nature of the Services, all sales are final and non-refundable once access has been granted, materials have been delivered, or the program has commenced, except as required by applicable consumer protection law.

Where a specific refund or guarantee window is offered on the sales page, that written offer prevails. Requests must be submitted in writing to contact@embodiedvision.co within the stated window.

Enrolling in a payment plan commits you to the full program fee. Discontinuing participation does not release you from the remaining instalments.

4. Scheduling, Attendance, and Rescheduling

• One-on-one sessions are booked via the scheduling link provided.
• Please reschedule at least 48 hours in advance. Sessions cancelled or missed with less than 48 hours' notice are forfeited.
• Live group calls are not rescheduled to accommodate individual conflicts. Replays are made available where applicable.
• Access to membership content and course materials is provided for the period stated at purchase.

5. Client Responsibilities

• Show up on time, prepared, and willing to engage with the work.
• Provide honest, accurate information so we can support you effectively.
• Consult a qualified medical or mental-health professional for any condition requiring such care.
• Take full responsibility for the decisions and actions you take during and after the engagement.

6. Confidentiality

We treat what you share in private sessions as confidential and will not disclose it without your consent, except where disclosure is required by law, necessary to prevent imminent harm, or required for billing, supervision, or professional consultation (in which case identifying details are minimised).

In group settings, you agree to respect the confidentiality of fellow participants and not to share their stories, identifying details, or contributions outside the container.

7. Recordings

Group calls, trainings, and certification sessions are typically recorded for the benefit of participants who could not attend live and for program quality. By participating, you consent to being recorded. Recordings may include your name (as displayed), voice, image, and the content of your contributions.

Recordings remain the intellectual property of Embodied Vision LLC and may be made available to enrolled participants and, in anonymised or excerpted form, used for promotional and educational purposes. If you do not wish to appear in a recording, please turn off your camera and notify the facilitator in writing before the session.

Clients may not record, copy, distribute, or publicly share program recordings or materials without our prior written permission.

8. Intellectual Property

All program materials, methodologies, workbooks, recordings, and trademarks (including "Embodied Vision™" and "Embodied Business™") remain the exclusive property of Embodied Vision LLC. Your enrollment grants you a personal, non-transferable, non-exclusive license to access and use the materials for your own learning. You may not resell, republish, or teach the proprietary methodology unless you hold a current, in-good- standing certification with written permission to do so.

9. Code of Conduct

We are committed to a respectful, inclusive, and trauma-informed environment. Harassment, discrimination, abusive behaviour, or breaches of confidentiality will result in removal from the program without refund.

10. Disclaimers and Limitation of Liability

Results from coaching, embodiment work, and personal-development programs vary and depend on each individual's engagement, circumstances, and effort. We make no guarantees of specific outcomes, financial results, or emotional results.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Services shall not exceed the total fees you paid us for the specific program giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

11. Termination

We may suspend or terminate your access to the Services for material breach of this Agreement, non-payment, or behaviour incompatible with the program environment, without refund.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Netherlands. Any dispute shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands.

13. Entire Agreement

This Agreement, together with the specific program enrollment terms and our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Embodied Vision LLC with respect to the Services.
